15 CASES OF LAND EVICTION HAVE BEEN REPORTED TO HUMAN RIGHTS COMMISSION

Fifteen cases of land evictions have been reported to the Human Rights Commission since January 2018, directors heard at the Human Rights and Governance consortium quarterly meeting held on 30th October 2018.

11 cases filed with the Commission involve farm dwellers and 4 affect settlers within the Swazi Nation Land. These cases include threats of action by Chiefs
and family members. One of the matters reported had to do with witchcraft allegation. Gogo Tjitji Nhlangano is accused by her community of practicing witchcraft. Others are appeals awaiting court rulings and district tribunals decisions.
Most of the pending land eviction cases are addressed through the Farm Dwellers Control Act.
Other matters are negotiated with the Commission after courts have granted eviction orders.
The 15 places are: Umbane; Mbondzela; Zombodze Emuva; Madonsa/SNPF; Madonsa/Tisuka; Dwaleni; Zenzile; Nkwene; Mhobodleni;
Maphalaleni; Ludlawini; Nsingweni; Lobamba;
John Cebile Mavuso; and Gogo Tjitji Nhlangano.
Case Status
Umbane/Malkerns – Matter was investigated, interventions made by challenging the matter in
court, unfortunately judgment for eviction was confirmed. Complainants were evicted and their
structures demolished.
Mbondzela/ Mahamba Gorge – Matter is still pending with the minister of natural resources for
appeal as provided for under the Farm Dwellers Control Act.
Zombodze Emuva – Matter is still pending with the District Tribunal as the appropriate structure
under the Farm Dwellers Control Act. Under monitoring
Madonsa/SNPF –Investigations were done and reports prepared. The Commission intervened
through litigation and filed a report in court. Court has directed that parties continue with negotiations.
Madonsa/Tisuka –Tisuka is in possession of an eviction order, has not been implemented yet pending negotiations with the Commission.
Dwaleni –Investigation done and report prepared. Matter is still pending with the Central Tribunal
as provided by the Farm Dwellers Control Act. Under monitoring.
Zenzile – Matter under appeal with the minister for Natural Resources.
Nkwene –The residents were evicted on the basis of a fraudulent court order. The Commission is
assisting the residents for redress.
Mhobodleni - No update
Maphalaleni – Matter is still pending with the minister of natural resources for appeal as provided
for under the Farm Dwellers Control Act.
Ludlawini - No update
Nsingweni- No update
Lobamba - No update
John Cebile Mavuso- No update
